• “Made-to-Order Items” means products manufactured, assembled, modified, or sourced specifically to fulfill a customer order.

5. Orders, Pricing & Payment

• All prices are subject to change without notice.

• Orders are subject to acceptance, product availability, and applicable regulatory requirements.

• We reserve the right to refuse or cancel orders for legitimate business, availability, or compliance reasons.

• Errors in pricing or product information may result in order cancellation and a refund of amounts paid.

• You authorize us and our payment processors to process payments associated with your order.

• Payment may be collected at the time of purchase, including for preorder and made-to-order products.

• Prices and applicable taxes will be confirmed during checkout.

 

First Nations GST/HST Relief: Eligible customers requesting GST/HST relief for qualifying deliveries to a reserve should contact us before their order is processed. We will verify eligibility and apply the appropriate tax treatment in accordance with CRA requirements.

 

6. Products & Availability

We make reasonable efforts to ensure product descriptions, specifications, images, pricing, and availability information are accurate.

 

However:

• Product images may differ slightly from the final product.

• Specifications may change due to manufacturer updates or product improvements.

• Products may be modified, discontinued, or temporarily unavailable.

• Displayed availability may change before an order is processed.

 

Some products listed on our Website may not be physically stocked at our warehouse and may be available through preorder, special order, or manufacturing arrangements.

Customers are encouraged to contact us before purchasing products that are not currently in stock.

 

7. Preorders & Out-of-Stock Items

Certain products may be available for purchase before they are physically available for shipment.

 

These include preorder products, temporarily out-of-stock products, and items awaiting delivery from suppliers or manufacturers.

 

Availability & Lead Times

Customers should contact us at info@cygnusarms.com to enquire about current availability and estimated lead times before placing an order.

 

Any estimated arrival, production, or shipping dates are provided as guidance only and are not guaranteed.

 

Actual availability may be affected by factors including:

• Supplier inventory and manufacturing schedules

• International shipping and customs clearance

• Import and export permits

• Government processing and regulatory approvals

• Transportation disruptions

• Production capacity and material availability

 

We make every reasonable effort to obtain and dispatch products as quickly as possible. However, circumstances outside our control may affect fulfillment timelines.

 

Preorder Payments & Cancellations

By placing a preorder, you acknowledge that the product is not immediately available for shipment and that fulfillment may be subject to an extended or uncertain lead time.

 

Preorders are considered final sale and are not eligible for voluntary cancellation or refund due to a change of mind, subject to applicable consumer protection laws.

 

Once a preorder has been placed, we may commit funds to suppliers, allocate incoming inventory, or begin procurement arrangements specifically for that order.

 

Where a preorder cannot be fulfilled, or where applicable law provides a cancellation or refund right, we will provide the remedies required by law.

 

Dispatch of Incoming Stock

Once preorder or out-of-stock products arrive at our warehouse, we generally aim to dispatch orders within 24 hours of receipt, excluding weekends and statutory holidays, provided all required documentation, inspections, and regulatory approvals are complete.

This dispatch timeframe is a target and is not guaranteed.

 

8. Made-to-Order & Custom Manufactured Products

Certain products sold by Cygnus are manufactured, assembled, or modified specifically for a customer.

 

These products may require additional production time depending on design requirements, material availability, machining schedules, finishing processes, and quality control.

• Estimated manufacturing lead times will be provided where reasonably available.

• Lead times are estimates and may change due to production requirements or circumstances outside our control.

• Production may not commence immediately upon order placement.

• Custom specifications must be confirmed before manufacturing begins.

 

Made-to-order and custom manufactured products are generally final sale once production or procurement has commenced, except where cancellation, refund, or other remedies are required by applicable law.

 

Changes requested after production has commenced may result in additional charges or extended lead times.

 

We will make reasonable efforts to complete and dispatch manufactured products as efficiently as possible while maintaining our quality and safety standards.

 

9. Shipping & Delivery

Shipping is governed by our Shipping Policy.

• Delivery timelines are estimates only.

• Preorder, out-of-stock, and made-to-order items are subject to additional fulfillment timelines.

• Carrier and regulatory delays may affect delivery.

• Additional shipping charges may apply where customers request separate shipments.

 

Risk of loss or damage during shipping will be allocated in accordance with applicable law.

 

10. Returns & Refunds

Returns and refunds are governed by our Returns & Refund Policy.

Preorder and made-to-order items are subject to the additional conditions outlined in Sections 7 and 8.

 

Nothing in these Terms excludes mandatory consumer rights, including applicable rights relating to non-delivery, defective products, or failure to fulfill an order.

 

11. Warranty

Warranty coverage is governed by our Warranty Policy.

 

12. Safety & Proper Use

You acknowledge that Products sold by Cygnus, including firearms, firearm components, tools, and accessories, may be inherently dangerous.

 

You agree:

• To use all Products safely and lawfully.

• To ensure proper installation and handling.

• To consult a qualified professional where necessary.

• To follow all applicable manufacturer instructions and safety requirements.

 

13. Legal Compliance & Licensing

Customers are responsible for complying with all applicable laws and regulations, including obtaining and maintaining required licences, permits, and approvals.

 

We reserve the right to:

• Request proof of licensing or eligibility.

• Verify required documentation before fulfilling an order.

• Refuse or cancel orders where legal compliance cannot be established.

 

Orders cancelled due to customer non-compliance may be subject to reasonable, legally permissible charges or deductions. Any refund obligations imposed by applicable law will be honoured.

14. Firearms & Controlled Items

• All firearms and controlled items are sold, transferred, and shipped strictly in accordance with applicable Canadian federal and provincial laws and regulations.

• Purchasers of firearms must hold a valid Possession and Acquisition Licence (PAL) with the appropriate privileges for the firearm being purchased.

• Where required by law, purchasers of regulated firearm components or other controlled items must provide appropriate licensing, identification, permits, or supporting documentation.

• Cygnus Atratus Arms Corp. will verify all required licensing and eligibility, including obtaining any mandatory transfer authorizations or reference numbers, before completing a regulated transfer.

• Customers may be contacted after placing an order to provide the information necessary for verification.

• Orders containing firearms or controlled items will not be transferred or shipped until all applicable legal and regulatory requirements have been satisfied.

• We reserve the right to refuse or cancel any order where the purchaser cannot establish the required legal eligibility.

 

15. Gunsmithing & Services

Gunsmithing, machining, and custom services are performed according to the agreed scope of work.

• Services may require an estimate, deposit, or full payment before work commences.

• Once work has commenced, cancellation may be restricted and charges may apply for work completed, materials ordered, and costs incurred.

• Additional work outside the original scope may require customer authorization.

• Service completion dates are estimates unless otherwise expressly agreed in writing.

 

Completed custom services are generally non-refundable except where required by applicable law.

 

Customers acknowledge the inherent risks associated with servicing used, modified, or previously damaged equipment.

 

Cygnus will exercise reasonable care in handling customer property and performing agreed services.

 

16. International Orders

International sales are subject to applicable import and export laws, licensing requirements, and regulatory approvals.

 

Customers are responsible for applicable destination-country requirements, including import permits, duties, taxes, and customs charges.

 

International orders may experience extended lead times due to permit processing, customs clearance, and transportation requirements.

 

We reserve the right to refuse or cancel international orders where legal or regulatory requirements cannot be satisfied.

 

Any refunds, charges, or remedies relating to cancelled or undeliverable international orders will be determined in accordance with applicable law and the circumstances of the order.

 

17. Assumption of Risk

You acknowledge that firearms, firearm components, tools, and related products may present significant risks when improperly installed, handled, modified, or used.

 

You accept responsibility for using products safely, lawfully, and in accordance with applicable instructions.

 

To the extent permitted by law, Cygnus is not responsible for injury, loss, or damage resulting from customer misuse, unauthorized modifications, or improper installation.

 

18. Installation & Modification Disclaimer

• Installation should be performed by appropriately qualified individuals.

• Improper installation, misuse, or unauthorized modification may affect warranty coverage.

• Cygnus is not responsible for damage directly resulting from improper installation or unauthorized modification, except where liability cannot legally be excluded.

 

19. Limitation of Liability

To the maximum extent permitted by applicable law:

• Cygnus is not liable for indirect, incidental, or consequential losses arising from circumstances for which liability may lawfully be excluded.

• Where legally permissible, our liability for a claim relating to a product or service is limited to the amount paid for the affected product or service.

 

Nothing in these Terms excludes or restricts liability that cannot legally be limited, including applicable statutory consumer rights.

 

20. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Cygnus against third-party claims, damages, or losses arising directly from your unlawful conduct, misuse of products, or material breach of these Terms.

This provision does not apply to losses caused by Cygnus's own negligence, misconduct, or breach of applicable law.

 

21. Force Majeure

Cygnus is not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, transportation disruptions, labour disputes, supplier interruptions, government actions, and regulatory delays.

We will make reasonable efforts to communicate significant disruptions and fulfill outstanding obligations as circumstances permit.

This provision does not override cancellation, refund, or other rights provided by applicable law.

22. Website Disclaimer

Website content is provided for general information purposes.

While we make reasonable efforts to maintain accurate and current information, errors or omissions may occur.

Nothing in this section limits statutory obligations concerning product descriptions, representations, or consumer protection.

 

23. Governing Law & Jurisdiction

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada.

 

Subject to any mandatory consumer protection or jurisdictional rights, disputes arising from these Terms shall be resolved in the courts having jurisdiction in Hamilton, Ontario, Canada.

 

24. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

25. Amendments

We may update these Terms periodically by posting a revised version on our Website.

 

The effective date will be updated to reflect material revisions.

 

Changes will not retroactively alter the terms of an existing accepted order without the customer's agreement, except where required by law.
